Legal Sports Betting States 2026: Where Is It Allowed and Where Is It Coming?

Sports betting has expanded rapidly since the Supreme Court struck down PASPA in 2018. As of 2026, more than 30 states have legal online sports betting, and several more are in various stages of legalization. Here''s the current map.

New York — The largest sports betting market in the US by total handle. Launched mobile betting in January 2022 and quickly became the nation''s leader. High tax rates (51%) but massive volume. DraftKings, FanDuel, Caesars, BetMGM, and others all operate here.

New Jersey — The original catalyst for national expansion. One of the most mature and competitive markets with 15+ active sportsbooks and consistently strong handle.

Pennsylvania — Large population, relatively high tax rate (36%), but well-established market with all major operators.

Illinois — Major market that has grown steadily since in-person registration requirements were lifted. Chicago is a significant sports market.

Michigan — Launched in January 2021; online casinos alongside sports betting create a strong combined market.

Colorado — Low tax rate (10%), well-regulated market, competitive operator landscape.

Arizona — Launched September 2021, tied to tribal gaming compacts and professional sports teams. Strong market with most major operators.

Ohio — Launched January 2023; large population makes this a top-5 market by handle.

Other operational states include: Indiana, Iowa, Virginia, Tennessee, Connecticut, West Virginia, Maryland, Louisiana, Wyoming, Kansas, Massachusetts, Vermont, North Carolina, Kentucky, and more.

States With In-Person Only

A handful of states require in-person registration or restrict wagering to physical locations (retail sportsbooks at casinos): Mississippi, Montana, New Mexico (tribal compact only), and a few others. Online betting is either restricted or awaiting enabling legislation.

The Big Three Holdouts: What''s Happening

Texas — The second-largest state by population has repeatedly failed to pass sports betting legislation, blocked primarily by opposition from tribal gaming interests and social conservatives in the legislature. Multiple bills have died in committee. The 2025 session made more progress than previous attempts; 2027 is the next realistic window.

California — Failed decisively in 2022 (Propositions 26 and 27). The conflict between tribal gaming interests and commercial operators makes consensus difficult. Multiple competing interests have prevented re-introduction of a viable ballot measure.

Florida — The most complicated situation. Hard Rock Bet (operated by the Seminole Tribe) launched in 2023 under a tribal gaming compact, paused due to legal challenges, and relaunched. Federal court battles over the compact''s legality continue. Status is legal but uncertain.

What''s Coming in 2026–2027

States expected to see legislative action: Georgia (multiple failed attempts, gaining momentum), Missouri (narrow failure in 2022, renewed push), Minnesota (tribal and commercial operator negotiations ongoing), and Hawaii (historically resistant, small signs of movement).

The pace of expansion has slowed — most of the high-population, sports-friendly states have already legalized. The remaining holdouts face structural political obstacles that are harder to overcome than simple public opinion.
